SENIOR AGENT – DURBAN

Job Purpose: 

The position of a Senior Agent is required in the National Bargaining Council for the Private Security Sector (“NBCPPS”), to promote monitor and enforce compliance of all Council Agreements and applicable legislation. The position ensures the effective and efficient supervision of the enforcement of all Agreements of the NBCPSS by delegating to and supervising Designated agents and managing all related activities..

Requirements

  • Minimum of an appropriate Grade 12 certificate and/or equivalent. 
  • Post Matric Qualification in Labour Relations Management, Industrial Relations, Labour Law, Human Resource Management and/or relevant. 
  • 3 – 5 years’ experience in Industrial/Labour Relations Management, Labour Law, Human Resources Management. 
  • 2 – 3 years’ experience in Collective Bargaining or Labour Law Enforcement environment an advantage. 
  • 1 – 2 years supervisory experience.
  • In possession of a current valid driver’s license and own reliable vehicle.

Duties and Responsibilities 

  • Supervise Designated Agent’s activities through, scheduling, allocating, guiding, and monitoring their activities, by checking weekly plans and activity reports as well as monthly reports submitted.
  • Develop action plans with Designated Agents to ensure the implementation of the strategic plan.
  • Planning and organising of daily, weekly, and monthly compliance and enforcement activities.
  • Compiling and Consolidation on team’s activity and statistical reporting. 
  • Promote, monitor, and enforce compliance with all Collective Agreements of the NBCPSS.
  • Interpretation of all clauses of the Collective Agreements to enforce all Council Agreements and issue Compliance Orders to companies that are noncompliant. 
  • Calculate and determine the amounts owing to Council due to noncompliance, conciliate disputes on non-compliance and issue a certificate of outcomes if dispute is unresolved for case to be referred to Arbitration for independent Commissioner to Arbitrate. 
  • Conduct routine proactive and reactive inspections, and issue findings report. 
  • Discuss and explain inspection reports with stakeholders to avoid future non-compliance. 
  • Receive complainant cases to investigate for enforcement, decide on appropriate form of investigation to be undertaken and ensure quality case investigations within prescribed period. 
  • Attend to enquiries and requests related to the role and purpose of the Council and other matters related to the collective agreements and applicable legislation.
  • Lead enforcement cases already referred to arbitration and ensure successful prosecution of cases during arbitration. 
  • Serving of marketing material to stakeholders during company visits and ensuring that all stakeholders regard the NBCPSS as a valuable partner. 
  • Planning and organising of daily, weekly, and monthly compliance and enforcement activities. 
  • Prepare and submit weekly route planning and activity reports.
  • Perform perception surveys with Stakeholders. 
  • Negotiate, drafting and signing of settlement agreement with employer representatives and submit such agreement to commissioners for approval as an Arbitration award. 
  • Resolve all unresolved queries related to allocated companies with employer representatives. 
  • Execute (Serve to companies) legal documents such as compliance orders, notice of arbitration, writ of execution, and awards. 
  • Training and Educating Industry HR Practitioners and employees in relation to Council and or provisions of Agreements. 
  • Address employees on Agreements and compliance related issues.  
  • Always building stakeholder relationships with employer and employee representatives.
  • Being a Custodian of the NBCPSS image and reputation, conduct oneself in a manner which will promote the Council. 
  • Cost centre management and control of cost items related to the function.
