The National Bargaining Council for the Private Security Sector (NBCPSS) has noted the statement issued by the South African Federation of Trade Unions (SAFTU) regarding findings that Mafoko Security Patrol (Pty) Ltd deducted provident fund contributions from employees’ wages but failed to pay them to the Private Security Sector Provident Fund (PSSPF).
This matter highlights the critical importance of compliance with Section 13A of the Pension Funds Act, which makes it a legal requirement for employers to pay over all employee deductions and employer contributions to the provident fund within the prescribed timeframes.
The NBCPSS reminds employers that failure to comply with these legal obligations constitutes a serious offence and undermines employees’ rights to their hard-earned benefits.
Employees who suspect non-payment of their contributions are urged to contact the PSSPF or the NBCPSS for assistance.
