Under the Co-operatives Act of 2005, it is explicitly stated that all worker co-operatives must comply with labour legislation. This includes adhering to the provisions of the MCA, which has been extended to cover non-parties. Furthermore, the Act defines an employee of a worker co-operative as any member or non-member who meets the definition of an ’employee’ as per the Labour Relations Act of 1995.
In light of these regulations, the NBCPSS emphasizes the importance of all worker co-operatives fulfilling their obligations under the MCA and other relevant employment laws. It is imperative for co-operatives falling within the NBCPSS’s scope to apply for exemptions if they believe they qualify, failing which they must adhere to the stipulations of the MCA.
